Eviction Moratorium Transition Bill SB282 Passed In Oregon

The Moratorium Transition Bill (SB282) has passed and is currently awaiting the governors’ signature. This bill doesn’t extend the current eviction moratorium on unpaid rent, but it does create many protections for tenants so that the negative financial consequences of COVID are minimized. We expect the Governor will sign this bill into law so it is important that Oregon Landlords understand the details. At RPMEducation.org we will create and schedule an Oregon Landlord Law Update class as soon as we know which laws are passed and they release the final approved text of each. In the meantime, we put together an overview of SB282 and at the end we include an update on all of the other laws that will apply to the Oregon Landlord.

  • Current unpaid rent protections end June 30th, 2021
  • Starting July 1st, 2021 rent is due on time and late fees can be assessed as well as non-payment of rent termination notices can be served
  • For unpaid rent charged from April 1st, 2020 through June 30th, 2021 (Tenant Protection Period) tenants have until February 28th, 2022 to pay the balance in full
  • Landlords can NOT report to consumer credit agencies debts from the Tenant Protection Period
  • Landlords can NOT consider unpaid rent during the Tenant Protection Period when screening an applicant
  • Landlords can NOT consider eviction judgements older than 5 years or that are based on claims that happened during the Tenant Protection Period when screening an applicant
  • Landlords may NOT asses fines or penalties for violations based on maximum occupancy guidelines or the maximum duration of a guest’s stay
  • If guest stays more than 15 days in a 12 month period landlords MAY require they satisfy screening criteria, but may NOT consider credit or income

There are still some bills pending that Oregon landlords should keep an eye on.

  • HB 2077: Establishes additional requirements when performing lead- based paint activities/renovations (PENDING SENATE VOTE)
  • HB 2098: Establishes Rental Assistance account for housing and community services to support affordable rental housing
  • HB 2163: Establishes long term rental assistance program in OHCS
  • HB 2484: requires landlords to allow childcare businesses
  • HB2583A: Prohibits public bodies from establishing occupancy limits based on familial relationships (PENDING GOVERNOR’S SIGNATURE)
  • HB 2729: Requires OHCS to pay residential and nonresidential landlords certain uncollected rents due between April 1, 2020 and September 30, 2020.
  • HB2736A: Requires housing providers to give tenants information notice on discrimination (PASSED HOUSING, IN SENATE COMMITTEE)
  • SB 330: Relating to the tax credit for forgiveness by landlord of tenants’ nonpayment of rent or other charges
